Terms of Service
Version 2026-10-20. These terms include our Data Processing Agreement.
1. Who we are and what these terms cover
WeDoAnyNail is an online booking and salon management service run by WeDoAnyNail ("we", "us"). You can contact us at [email protected].
These terms are a contract between us and the business that creates a WeDoAnyNail account ("you"). They cover this website, your salon's staff app and booking page, the SMS gateway app and our related services (together, "the Service").
2. Business customers only
The Service is only for businesses. By creating an account you confirm that:
- you are acting for the purposes of your trade, business or profession and not as a consumer;
- the person accepting these terms is at least 18 years old and is the owner of the business or is authorised to bind it;
- your business and the person or company that runs it hold the licences, registrations, qualifications and insurance that the law requires for your salon and your treatments, or that a careful salon would hold, and will keep them up to date.
3. Your account and its security
- Give us accurate details and keep them up to date.
- Every person who uses the Service needs their own login. Do not share passwords or login codes, and make sure that the staff accounts you create are used only by your staff.
- When someone leaves your salon or no longer needs access, change any password they knew and remove their access, or ask us to remove it.
- We will never ask you for your password or for a login code.
- You are responsible for everything done through your account and your staff accounts. We are not responsible for losses caused by passwords or codes that were shared, or by a login that was not removed, unless the loss was caused by our own breach of these terms, our negligence or our breach of the law.
- Tell us straight away at [email protected] if you think someone has used your account without permission.
4. Free trial
Each new salon gets a free trial of 14 days, with no payment details needed. If you have not chosen a paid plan when the trial ends, online booking for your salon is paused. We may delete the salon and its data 90 days after the trial ended. The trial is provided as it is, and our liability is limited as set out under "Our liability".
5. Plans, prices and payment
- Paid plans are monthly subscriptions. The price of each plan and what it includes, such as the number of stylists, text messages a month and custom domains, are shown on our pricing page when you subscribe.
- Prices are in pounds sterling and exclude VAT. Where VAT or a similar tax applies, we add it at the applicable rate. Business customers outside the UK may have to account for it themselves under the reverse-charge rules.
- We bill you monthly in advance through our payment provider, Stripe. Your subscription renews automatically each month until you cancel. Fees already paid are not refundable, except where these terms or the law say otherwise.
- If a payment fails, we will tell you and Stripe will try again. If the payment is still outstanding after those attempts, we may suspend online booking for your salon until it is paid.
- We may change our prices or plan allowances by giving you at least 30 days' notice by email. The change applies from your first billing date after the notice period. If you do not agree, you can cancel before then.
6. Text messages
- Texts to your clients are sent through an Android phone at your salon running our gateway app, using your SIM card. Your salon is the sender, and you pay your mobile network's charges.
- You are responsible for the gateway phone, its SIM card and its connection. We do not guarantee that a text will be sent or delivered, for example if the phone is offline, out of credit or blocked by the network.
- You are responsible for the content of your texts and for complying with the law on electronic messages, including getting your clients' prior consent before sending them marketing messages (in the UK under the Privacy and Electronic Communications Regulations, in Germany under § 7 UWG).
- Your clients can stop marketing messages in their customer account. If a client asks you in any other way to stop sending them marketing, record it in the Service or stop it straight away, and in any case within 48 hours.
- Your plan sets how many booking confirmations, reminders and free-slot texts can be sent each calendar month. When the allowance is used up, those texts stop until the next month. Login codes are always sent.
7. Using the Service properly
Use the Service only to run your salon and only in line with the law. You must not:
- send spam, or texts or content that are unlawful, misleading or offensive, or that infringe anyone's rights;
- advertise or offer prescription-only medicines, such as botulinum toxin, or treatments that only medically qualified people may lawfully provide, unless the law allows you to;
- enter payment card numbers, security codes, bank login details, passwords or login codes into notes or other free-text fields. We may delete any we find, and doing so is not a data breach;
- upload malicious code, try to get around our security, access other salons' data, or test, probe or overload the Service without our written permission;
- copy, resell, sublicense or reverse engineer the Service, except where the law allows it;
- use the Service in a way that could harm us, the Service or our other customers.
You are responsible for your dealings with your clients, including your treatments, prices, cancellations, deposits, refunds and complaints. We are not a party to them.
8. Your content
- Your content is everything you or your staff add to the Service, such as your salon name, logo, pictures, stylist photos, menu, descriptions, prices, About and legal pages and text messages. You own it, or the people you licensed it from do. Nothing in these terms transfers it to us.
- You give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, adapt for display (for example resize, crop or compress images), publish and send your content, as needed to provide, secure and support the Service. That includes showing it on your booking pages and in your staff app, sending it in your texts and emails, and letting the sub-processors listed in our Data Processing Agreement handle it for us.
- The licence ends when you delete the content or your salon is deleted. Copies may remain in our backups until those are deleted, and texts that were already sent and pages that were already saved by others stay where they are.
- You confirm that you own your content or have permission to use it in this way, and that it is accurate and lawful. Pictures you copy from other websites or social media usually need the photographer's permission.
- If a picture shows a person who can be identified, such as a client or a member of staff, you must have that person's consent, and a parent's or guardian's consent for anyone under 18. Keep a record of it and show it to us if we ask. If someone withdraws their consent, remove the picture.
- We will only show your salon's name or logo on our own website or in our marketing, for example as one of our customers, if you agree. You can withdraw that agreement at any time by email, and we will then remove it within a reasonable time.
9. Content that breaks the law or these terms
- We do not check content before it is published. Anyone can tell us about content on the Service that they believe is illegal or infringes their rights, for example a copied photo, as explained on our company information page.
- If we receive such a report, or otherwise reasonably believe that content is illegal, infringes someone's rights or breaks section 7, we may remove it, disable access to it or restrict the feature that shows it. We act carefully and only as far as needed, and where the law and the circumstances allow, we first ask you to correct or remove the content yourself.
- When we remove or restrict your content or your account, we tell you which content is affected, the reason, whether the decision was based on a report, and how you can object. You can object by replying to us at [email protected]. We will review the decision again, taking your reasons into account, and if we were wrong, we will restore the content.
- We may share information with the authorities where the law requires it, for example if content suggests a threat to someone's life or safety.
10. Your data
- The data that you and your clients put into the Service is yours. Section 8 explains what we may do with your content, and the Data Processing Agreement, which forms part of these terms, explains how we handle personal data. For your clients' and staff's personal data, you are the controller and we are your processor.
- You can ask us for an export of your salon's data at any time while your account is open and for 30 days after it ends. After those 30 days, or 90 days after an unpaid trial ended, we may permanently delete your salon and its data, except anything we must keep by law, such as our invoices.
- Keep your own copies of any data you need, for example by exporting it regularly.
- If your data is lost or corrupted because of our breach of these terms or our negligence, we will use reasonable efforts to restore it from the most recent backup we hold, at our own cost.
- We may use anonymous, aggregated information about how the Service is used, which identifies neither you nor any other person, to run and improve the Service.
11. Legal texts and other starting content
- When you create a salon, we fill in draft privacy, terms and legal-notice pages, text messages, a menu and descriptions for your booking page. They are a starting point, not legal advice, and we do not promise that they are complete, correct or suitable for your salon or country.
- You are responsible for checking and adapting them, ideally with a lawyer, for keeping them up to date, and for complying with the laws that apply to your salon, including data protection, consumer and e-commerce law.
- We own the starting content we provide. You may use, change and copy it for your own salon, including on your own website and after you stop using the Service, but you may not sell it or give it to others to use.
12. Custom domains
If you connect your own domain, you are responsible for registering and renewing it and for its DNS settings. We are not responsible if your booking page cannot be reached because of your domain or its DNS.
13. Availability, support and changes to the Service
We will provide the Service with reasonable care and skill. We aim to keep it available at all times, but we do not promise that it will be uninterrupted or error-free: it may be unavailable for maintenance, updates or reasons outside our control. Support is by email, on a reasonable-efforts basis.
We may change and improve the Service. If a change significantly reduces what you pay for, we will tell you in advance where we can, and you can cancel and receive a refund of the fees you paid for the period after the change.
14. Our intellectual property
We or our licensors own the Service, its software, design and documentation, and the WeDoAnyNail name and logo. While your trial or subscription is active, we give you a non-exclusive, non-transferable right to use the Service for your salon under these terms. You may say that your salon uses WeDoAnyNail, but you may not otherwise use our name or logo, or anything that could be confused with them, without our written agreement. If you send us suggestions, we may use them freely.
15. Suspension
- We may suspend online booking for your salon if you do not pay, as described in section 5.
- We may also suspend all or part of the Service immediately, without notice in advance, if we reasonably believe that your account has been compromised, that your gateway phone or your account is being used to send spam or other unlawful messages, that you are using the Service unlawfully, or that it is needed to protect the Service, other customers or anyone's safety. We suspend only as much and for as long as needed, tell you why as soon as we can, and restore the Service once the problem has been dealt with.
16. Cancelling and ending the Service
- You can cancel at any time from your account page or the billing portal. Cancellation takes effect at the end of the billing period you have paid for, and your salon stays online until then. We do not refund part months.
- We may end your subscription by giving you at least 30 days' notice by email; we then refund any fees you have paid for the period after it ends.
- Either of us may end these terms immediately by notice if the other seriously breaches them and, where the breach can be put right, does not do so within 14 days of being asked to; or if the other becomes insolvent, enters administration, liquidation or a voluntary arrangement with creditors, has a receiver appointed, or stops trading. We may also end them immediately if you repeatedly break these terms or if the law requires us to.
- Sections 8 (as far as backups and copies are concerned), 10, 14, 17, 18, 21 and 22 continue to apply after these terms end.
17. Our liability
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
- Subject to that, we are not liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss of profits, sales, business or revenue; loss of goodwill or reputation; loss of anticipated savings; business interruption; loss or corruption of data (other than our duty to restore it under section 10); or any indirect or consequential loss.
- Subject to the first point, our total liability to you arising out of or in connection with these terms and the Service in any 12-month period is limited to the greater of £100 and the fees you paid us in the 12 months before the event giving rise to the claim.
- Except as set out in these terms, all terms implied by law are excluded to the extent the law allows.
18. Your responsibility to us
You will compensate us for any losses, damages and costs (including reasonable legal costs) we suffer because of a claim by anyone else, including your clients, your staff, a rights holder or a regulator, arising from:
- your content, including claims that it infringes someone's copyright or other rights;
- the texts you send, including marketing messages sent without valid consent;
- your treatments and services, and clients' visits to your salon;
- your breach of data protection law, of these terms or of any other law;
- your other dealings with your clients and staff.
We will tell you promptly about any such claim and let you take part in dealing with it.
19. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as failures of power, the internet, mobile networks or third-party services, attacks we could not reasonably prevent, fire, flood, war, strikes or acts of government.
20. Changes to these terms
We may update these terms, for example when we change the Service or the law changes. We will tell you about significant changes by email or in your account at least 30 days before they apply, unless the law requires a change sooner. If you do not agree, you can cancel before the change applies. If you keep using the Service after that, the new terms apply. We may also ask you to accept new terms in your account.
21. General
- These terms, the Data Processing Agreement and the documents they refer to are the whole agreement between us about the Service. You confirm that you have not relied on any statement that is not in them. This does not limit liability for fraud.
- We may transfer our rights and obligations to another business, for example if we sell our business, and will tell you if we do. You may transfer yours only with our written agreement, which we will not refuse unreasonably.
- If you sell your salon or it changes owner or management, tell us. We move the account and its data to someone else only on the written instructions of the account holder, or where the law requires it. You are responsible for making sure that passing your clients' data to a new owner is lawful, and you remain responsible under these terms until the transfer is done.
- If a court finds part of these terms invalid, the rest stays in force. If we delay enforcing these terms, we can still enforce them later.
- Nobody else has any rights under these terms (Contracts (Rights of Third Parties) Act 1999).
- We may send you notices by email to your account's email address. You can send notices to [email protected].
22. Complaints, governing law and courts
- If you are unhappy with the Service or have a dispute with us, email us at [email protected] first. If our first answer does not resolve it, a director will review it. We aim to give you our final answer within 28 days.
- Neither of us will start court proceedings until 28 days after the complaint was made, unless urgent relief, such as an injunction, is needed or proceedings are needed to stop a claim running out of time.
- These terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
